Florida DivorceThere are a few basic divorce rules that apply to everyone seeking a divorce in Florida, including military families: - Residency: In order to seek a divorce in Florida, one or both parties must have been a resident of the state for at least 6 months prior to filing.
- Fault: Florida is a no fault state: you do not need to prove that someone was at fault, only that the marriage is irretrievably broken. Mediation: All family law cases will be referred to mediation before the parties see a judge. Mediation offers a great advantage because the couple may be able to come up with much more creative solutions to meet their particular family situation. A judge does not have the same degree of flexibility.
